Terms & Conditions
Section 1: Introduction
Welcome to www.archibaldlondon.com (the “Site”), operated by Athene 888 OÜ, a company incorporated in the Republic of Estonia, trading as Archibald (“we”, “us” or “our”). These Terms of Use (“Terms”) govern all access to and use of the Site and the related services and features (collectively, the “Services”) when purchased from a delivery address within the European Union.
By accessing or using the Site, you confirm that you have read, understood, and agreed to be legally bound by these Terms, which incorporate our Privacy and Cookie Policy (available at archibaldlondon.com/privacy). If you do not accept these Terms in full, you must not use the Site or any Services.
These Terms are governed by the laws of the Republic of Estonia, including in particular the Estonian Law of Obligations Act (Võlaõigusseadus). Nothing in these Terms is intended to override or limit any statutory consumer protection rights available to you under applicable law, including rights available to you under the consumer protection law of your country of habitual residence to the extent those rights provide stronger protection than Estonian law or these Terms.
We reserve the right to update, amend, or replace any part of these Terms at any time. Where required by applicable law, we will provide advance notice of material changes. It remains your responsibility to review this page periodically. Continued use of the Site following the posting of any changes constitutes your acceptance of those changes.
We do not guarantee that the Site, or any content on it, will always be available or uninterrupted. Access to the Site or Services may be restricted or terminated by us at any time without notice, particularly where we believe your use violates applicable laws or these Terms.
If you have any questions about these Terms or how they apply to you, please contact us at info@archibaldlondon.com before continuing.
Privacy and Cookie Policy: Your use of the Site and our Services is also governed by our Privacy and Cookie Policy, available at archibaldlondon.com/privacy, which forms part of these Terms. It explains how we collect, use, and protect your personal information, including any information collected through cookies and similar technologies on the Site. By using the Site, you confirm that you have read and understood it.
Marketing communications: From time to time we may send you marketing communications about Archibald products, campaigns, or membership programmes. You may opt out at any time by clicking the unsubscribe link in any marketing email, or by writing to us at info@archibaldlondon.com. Operational communications relating to your orders, account, or membership are not subject to opt-out and will continue regardless of your marketing preferences.
You may contact us through any of our official communication channels, including email at info@archibaldlondon.com, WhatsApp, Facebook Messenger, and Instagram direct message. These are our preferred channels for formal correspondence, and we recommend using them to ensure all communications are properly recorded. Where arrangements or agreements are made through other channels or circumstances, Archibald will honour these provided they are evidenced in writing and the content is clear and verifiable. Archibald cannot be held responsible for communications that cannot be verified, are sent through unverified channels purporting to represent our team, or where no written record exists.
1.1 Scope and Application
These Terms apply to customers purchasing from a delivery address in one of the twenty-seven member states of the European Union, through our European Union Site. Customers purchasing from countries in the European Economic Area that are not EU member states (Norway, Iceland, and Liechtenstein) are served by our Rest of World Terms and should refer to those instead. Customers purchasing from the United Kingdom, the United States, or any other country outside the European Union are also served by separate localised Terms.
Seller of record
All sales made through the European Union Site are made by Athene 888 OÜ, a company incorporated in the Republic of Estonia, with its registered office at Harju maakond, Tallinn, Kesklinna linnaosa, Järvevana tee 9, 11314, Estonia. Athene 888 OÜ trades as “Archibald.”
Shipping
Orders are dispatched from one of our fulfilment warehouses in the European Union or from our warehouse in the United Kingdom, depending on the stock location of the individual item. The dispatch origin for each item is displayed on the product page and again in your cart before you complete your purchase.
Currency and pricing
Prices on the European Union Site are displayed and charged in Euros (EUR), including for customers in EU member states whose national currency is not the Euro.
Customs, duties, and taxes
For orders dispatched from our European Union fulfilment warehouses, prices displayed at checkout include VAT at the rate applicable to your delivery address, in accordance with the EU One-Stop Shop (OSS) scheme under which Athene 888 OÜ is registered. You will not be asked to pay any additional VAT, customs duties, or clearance fees on delivery.
For orders dispatched from our United Kingdom warehouse, two delivery options are available at checkout:
(a) Standard delivery. Prices displayed are shown exclusive of local VAT and import duties. As the customer of record, you are the Importer of Record for your order and are responsible for paying any applicable VAT, customs duties, and clearance fees directly to your local customs authority upon delivery. Where the courier collects these charges on behalf of the authority, they will be presented to you at the point of delivery. No additional charge is applied at checkout for this option.
(b) Cleared for You enhanced delivery. Archibald handles import clearance of your order into the European Union via our EU warehouses, and dispatches the goods onward to your address. All applicable charges are handled by Archibald as part of this bundled service, and no further amounts are payable upon delivery. An additional service charge applies and is shown to you at checkout. See the subsection ‘Cleared for You — enhanced delivery option for UK-dispatched orders’ below for full details.
The dispatch origin, the delivery option available, and the applicable charges are disclosed on the product page and again in your cart before you complete your purchase.
Cleared for You — enhanced delivery option for UK-dispatched orders
For orders dispatched from our United Kingdom warehouse, you may select our “Cleared for You” delivery option at checkout where applicable. This is a premium delivery service in which Archibald handles the import clearance of your order from the United Kingdom into the European Union through our EU warehouses, and then dispatches the goods from the EU to your delivery address.
How the charge is calculated. The Cleared for You charge is a single bundled service fee that reflects the full cost to Archibald of providing this service. This includes import clearance, routing and logistics between our UK and EU warehouses, administrative handling, and all associated processing costs. The specific amount for your order depends on your delivery country and the specifics of your order, and is calculated and shown to you at checkout before you confirm your purchase. By selecting this option, you confirm that you accept the additional charge in full as a service fee.
No additional charges on delivery. Where you have selected the Cleared for You option, no further amounts are payable by you to your local customs authority upon delivery. All applicable charges are handled by Archibald as part of this service.
Delivery timing. The Cleared for You service involves additional logistical steps — import clearance at our EU warehouse, re-routing from the EU to your delivery address, and the related documentation. As a result, delivery under this service typically takes slightly longer than our standard self-clearing option. Estimated delivery timings are shown at checkout. Please note that these timings are indicative estimates only and may be subject to delays that are outside our reasonable control, including (but not limited to) customs processing times, courier capacity, border controls, and other logistics factors. By selecting this option, you accept that longer delivery times are an inherent part of the service and are not a basis for cancellation or refund.
Refund treatment of the Cleared for You charge.
In line with Article 14 of the EU Consumer Rights Directive 2011/83/EU, we are entitled to deduct the direct cost of enhanced delivery options from any refund. Accordingly, the Cleared for You charge is treated as follows:
Where you cancel your order before the clearance process has commenced on your behalf, the Cleared for You charge will be refunded in full along with the goods price (less any other applicable deductions set out in Section 14).
Where you cancel your order after the clearance process has commenced on your behalf — including where the goods are in transit, have cleared into the EU, or have been delivered — the Cleared for You charge is not refundable, as the service has been performed by the point of cancellation. This includes all elements of the service — administrative handling, clearance processing, routing, logistics, and the costs we incur to coordinate and complete it. Although some individual components of the service may have theoretical recovery pathways to us, these are offset by the broader costs of providing the service, including non-recoverable administrative, operational, and processing costs incurred specifically for your order. Accordingly, no portion of the Cleared for You charge is refundable where the service has been performed.
Please note: Even where you notify us of your intention to cancel before clearance has physically taken place, we may be unable to prevent the shipment from clearing. There is an inherent delay between us receiving your cancellation request and us being able to communicate with the courier to halt the shipment. During this period, the shipment may already have progressed to a stage from which it cannot be withdrawn. In such cases, the Cleared for You charge remains non-refundable, as the service has been completed and the associated costs have been incurred by Archibald. We will always endeavour to prevent clearance where possible, but we cannot guarantee this and the timing is dependent on courier processes outside our control.
For this reason, if you decide to cancel your order, please inform us at info@archibaldlondon.com as soon as possible — ideally within hours of placing the order, not days. The earlier we are notified, the greater the likelihood we can prevent clearance and refund the charge.
In-transit cancellation. If you cancel your Cleared for You order while it is already in transit between our UK warehouse, EU warehouse, or your delivery address, the standard in-transit return fee set out in Section 9.2 (€50 per item) will apply in addition to the non-refundability of the Cleared for You charge above. The combination of these costs may result in a materially reduced refund. For this reason, we strongly encourage you to confirm your order carefully before selecting the Cleared for You option, and to notify us as soon as possible if cancellation becomes necessary.
Standard delivery option. The standard self-clearing delivery option (where you remain the Importer of Record and handle customs on arrival) remains available at no additional charge for all UK-dispatched orders. If you prefer this option, select it at checkout.
Returns
For eligible returns, the customer is responsible for arranging and paying for return shipping to our United Kingdom warehouse (or to an alternative address we specify in writing). In some cases, where we do not have preferred logistics arrangements in your country, we may ask for your assistance in arranging the return; in such cases we will confirm the arrangement in writing. For orders where you paid import VAT, customs duties, or other local taxes on delivery, those amounts are not refundable by Archibald and remain your responsibility to reclaim (where possible) from your local customs authority. We will provide any documentation reasonably required to support such a reclaim.
Right of withdrawal
You have a statutory right to withdraw from your purchase within the statutory withdrawal period under EU consumer law. In addition to this statutory right, we provide a commercial return period on top of that, giving a total of 28 days from receipt of the goods to request an exchange or return. Specific product carve-outs apply to final-sale categories and made-to-order items (see Section 14). You may exercise your right of withdrawal using the Withdrawal Button available in the footer of the Site, in your Archibald account, and in your order confirmation email, or by contacting us at info@archibaldlondon.com. Full details of the withdrawal process are set out in Section 14.
Governing law
These Terms are governed by the laws of the Republic of Estonia, and any dispute arising in connection with them may be brought before the courts of Estonia on a non-exclusive basis. Where you are a consumer resident in another EU member state, mandatory consumer protection rules of your country of habitual residence continue to apply to the extent they provide you with stronger rights than these Terms or Estonian law (see Section 19.2).
Section 2: Updates to These Terms
We may revise these Terms from time to time to reflect changes in our operations, services, legal obligations, or in response to feedback from our community. The most current version of these Terms will always be available on our Site, with the effective date clearly indicated at the top.
We will give reasonable advance notice of any material change before it takes effect. Where the change is significant, we will notify registered customers by a prominent notice on the Site and, where appropriate, by email. Minor changes that do not affect your rights or obligations (for example, corrections, formatting, or clarifications) may be made without separate notice. If you continue to use the Services after the effective date of a change, that use indicates your acceptance of the revised Terms.
Where a change to these Terms would reduce your rights in relation to an order you have already placed, the version of the Terms in force at the time of your order will continue to apply to that order.
Paid memberships
Material changes to the Kakumei Dantai or Ronin membership programmes (other than membership price) are determined by binding votes of Kakumei Dantai holders through the on-chain governance process set out in Section 6, rather than by the general update mechanism above. Price changes apply only to new members joining after the change.
Please note: any discounted sale, whether through a promotional initiative or coupon code, is subject to the specific terms communicated at the time of the offer, including any restrictions on returns, exchanges, or use in combination with other promotions.
Section 3: Eligibility
To use our Services, you must be at least 18 years of age and capable of entering into legally binding agreements under the law applicable to you. By using the Site, you confirm that you meet these requirements.
If you are under 18, you may only use the Services under the direct supervision of a parent or legal guardian who accepts responsibility for your use. In such cases, all interactions are deemed to be made by the supervising adult.
You are solely responsible for ensuring that your use of the Services, including the purchase of any products, complies with all laws, rules, and regulations applicable to you. By continuing to access or use our Services, you represent and warrant that you meet all eligibility criteria outlined in these Terms.
We reserve the right to deny access to or restrict the use of the Services to anyone, at any time, for any reason, including failure to meet eligibility requirements.
Please note that the purchase, import, and possession of knives and bladed products is subject to strict laws that vary between EU member states. By purchasing any knife or bladed item through our Site, you confirm that you are of legal age to do so and that the purchase, possession, and use of such items is lawful for you under the laws of your country of habitual residence. It is your sole responsibility to verify and comply with the applicable laws before placing your order. Archibald accepts no liability for purchases made in contravention of applicable law.
Our Services are intended for personal, non-commercial use only. Purchases made on behalf of third parties or for resale purposes are not permitted unless explicitly authorised by Archibald.
Misuse of our Services
We reserve the right to restrict or terminate your access to the Services, refuse to accept future orders or returns, and decline to honour membership benefits, where we identify misuse of our Site, our policies, or our team. Misuse includes (without limitation): abuse of our returns policy through repeated or vexatious return requests; purchasing on behalf of third parties or for resale without our prior written authorisation; misuse of membership pricing as set out in Section 6; fraudulent chargebacks or payment disputes; and harassment or abuse of our team. Where action is taken under this clause, we will communicate the decision to you and, where appropriate, refund any unfulfilled orders subject to the standard return terms.
Section 4: General Shopping
We’ve designed our website to be as straightforward and intuitive as possible, and we’re always looking for ways to improve. If something is unclear, or if you have suggestions to make the experience better, feel free to reach out at info@archibaldlondon.com.
While we aim to keep all product information accurate and up to date, there may occasionally be errors or omissions in product descriptions, pricing, or availability. We reserve the right to correct any such errors at any time, including after an order has been placed. In the event of a pricing error, we will notify you promptly and give you the option to proceed at the correct price or cancel your order for a full refund. We will not fulfil an order at an incorrect price without first obtaining your confirmation. Please note that for made-to-order items where production has already commenced at the time the error is identified, we will honour the original price paid and fulfil the order accordingly.
Prices and currency
All prices on the European Union Site are displayed and charged in Euros (EUR), including for customers in EU member states whose national currency is not the Euro. For orders dispatched from our European Union fulfilment warehouses, prices displayed at checkout include VAT at the rate applicable to your delivery address, in accordance with the EU One-Stop Shop (OSS) scheme under which Athene 888 OÜ is registered. For orders dispatched from our United Kingdom warehouse, prices displayed at checkout are shown exclusive of local VAT and import duties, which are payable by you on delivery as the Importer of Record. The dispatch origin and the applicable VAT and duty treatment are disclosed on the product page and again in your cart before you complete your purchase. Prices do not include delivery charges, which are displayed at checkout before payment is confirmed.
By placing an order, you confirm that all information submitted is accurate and complete. We may need to contact you to confirm certain details before an item can be processed or dispatched, particularly in cases involving sizing, colour selection, delivery address, or customisation. Please ensure you respond to any such requests in a timely manner, as we cannot be held responsible for delays caused by late or incomplete responses from you.
A binding contract of sale is formed when we accept your order and confirm dispatch (or, for made-to-order items, when we confirm production has commenced). Until that point, we reserve the right to decline or cancel orders at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability. Where a payment has already been processed for a cancelled order, a full refund will be issued to your original payment method within 14 days.
Our Services are intended for personal, non-commercial use only. Any orders placed for resale, commercial redistribution, or on behalf of a third party without our prior written authorisation may be cancelled without notice.
Samples, One-offs, and Discontinued Items
From time to time, Archibald offers a selection of sample pieces, one-off items, and discontinued products at discounted prices. These items are sold on a final-sale basis and are not eligible for change-of-mind return under our standard 28-day return window. Your statutory rights in respect of goods that are defective, damaged on arrival, not as described, or incorrectly supplied remain unaffected. The final-sale basis will be clearly indicated on the individual product page at the time of purchase.
Table by Archibald
Archibald has developed a product range under the Table by Archibald programme. This programme has not yet officially launched. In the meantime, any communications or arrangements made directly with our team in connection with Table by Archibald products will be treated in good faith and we will do our best to honour any commitments made through those conversations, subject to these Terms.
Section 5: Delivery Windows
We work closely with our craftsmen and logistics partners to deliver your orders as efficiently as possible. However, some products require longer lead times due to the nature of their production, material sourcing, or customisation. Please refer to the individual product pages for estimated timeframes, or contact us at info@archibaldlondon.com for guidance before placing your order.
Delivery estimates provided at the time of purchase are indicative only and do not constitute a guaranteed delivery date. Delays may occur due to circumstances beyond our reasonable control, as set out in Section 19.7 (Force Majeure). In such cases, we will notify you as soon as reasonably practicable and work to minimise any impact on your order.
Made-to-Order and No-Returns Products
Certain products are produced exclusively to order and fall under the exception to the 14-day right of withdrawal set out in Article 16(c) of the EU Consumer Rights Directive 2011/83/EU and §53(4)(3) of the Estonian Law of Obligations Act, which provides an exception for goods made to the consumer’s specifications or clearly personalised. These include the Goodyear footwear, Vicuña pieces, customised eyewear, made-to-measure shirts, copper pan sets, and any other items produced on a made-to-order or final-sale basis as indicated on the individual product page. Additionally, any bespoke customisation requested through our customer support team, whether by email, phone, WhatsApp, or any other channel, will also be treated as a made-to-order item and is equally subject to our no-returns policy on a change-of-mind basis. By requesting such a customisation, you acknowledge and accept these terms regardless of the channel through which the request was made.
Your statutory rights in respect of goods that are defective, damaged on arrival, not as described, or incorrectly supplied remain unaffected.
If you require any such product by a specific date, you must contact us before placing your order at info@archibaldlondon.com so we can advise on feasibility. We cannot guarantee delivery by a requested date unless we have expressly agreed one with you in writing.
Once production has commenced on a made-to-order item, the order cannot be cancelled. Where cancellation is requested before production has begun and we are able to accommodate it, a cancellation fee may apply to cover any material, labour, or administrative costs already incurred.
Section 6: Membership
Archibald offers two membership programmes, each granting access to different levels of pricing, benefits, and community participation. By purchasing a membership, you agree to the terms set out in this section in addition to the general Terms governing your use of the Site and Services. The following general terms apply to both programmes. Specific terms for each membership are set out below.
General Membership Terms
Both memberships are purchased on a non-refundable basis after the statutory cancellation period. You have a 14-day right to cancel your membership under Article 9 of the EU Consumer Rights Directive 2011/83/EU and §56 of the Estonian Law of Obligations Act, beginning on the day the membership is activated, provided you have not used any material membership benefit (such as making a purchase at Naked or Undressed pricing, casting a vote, or exercising priority access) during that period. Where you have used a material membership benefit within the 14-day period, your right of cancellation is lost in accordance with the exception for services that have been fully performed with your prior express consent.
Archibald reserves the right to make non-material changes to the membership programmes at any time, including operational updates, corrections, clarifications, and other adjustments that do not affect the core benefits or contractual mechanics of either programme. Material changes are governed by the binding-vote process set out below under Member Governance, and require Kakumei Dantai holder consent before taking effect. In the event that Archibald discontinues a membership programme entirely, the matter will be handled on a case-by-case basis with existing holders.
Misuse of membership pricing, including but not limited to purchasing on behalf of third parties, reselling products purchased at membership pricing, or sharing access with non-members, may result in immediate termination of membership without refund.
Nature of the membership
Kakumei Dantai and Ronin are membership programmes that grant access to the commercial benefits set out in this Section 6. Neither programme is, nor is intended to be, a financial product, investment contract, security, collective investment scheme, profit-sharing instrument, or claim on Archibald’s commercial performance. The Kakumei Dantai NFT and the Ronin token are the technical records of membership and the means by which benefits are accessed. They are not investment assets. Any secondary-market value the Kakumei Dantai NFT may acquire is a function of market behaviour, not a promise or representation from Archibald. Archibald makes no undertaking that any membership token will retain or increase in value, and does not provide investment, tax, or legal advice in connection with the purchase, holding, or transfer of any membership token. You are solely responsible for understanding the legal, tax, and regulatory treatment of holding the token under the law applicable to you.
Member Governance: The Archibald DAO
Both Kakumei Dantai and Ronin memberships include access to the Archibald DAO, an on-chain governance forum where members vote on matters concerning the membership programmes and the broader Archibald business. Voting takes place on the Polygon blockchain, with each member’s voting power tied to their membership token.
Voting weight. On advisory votes (which are open to all members), each Kakumei Dantai token carries two votes and each Ronin token carries one vote. Binding votes are reserved to Kakumei Dantai holders only, with each Kakumei Dantai token carrying one vote.
Two types of vote. The Archibald DAO holds two distinct types of vote, and the difference matters:
- Binding votes apply to material changes to the Kakumei Dantai or Ronin membership programmes themselves. This includes any modification to the core benefits of a membership, the conditions under which those benefits apply, or the technical or legal mechanics by which the membership is held. Only Kakumei Dantai holders may vote on binding matters, including binding votes that affect the Ronin programme. A binding vote is adopted if it receives a simple majority of votes cast within the voting window, subject to a minimum quorum of 25% of eligible Kakumei Dantai holders participating. Once adopted, the change takes effect on the date specified in the proposal and binds all members of the relevant programme.
- Advisory votes apply to matters of product direction, brand strategy, partnership choices, and other commercial decisions where Archibald wants to invite member input. Both Kakumei Dantai and Ronin holders may participate in advisory votes, with voting weight as set out above. These votes are taken seriously by the Archibald team and are part of how we run the brand, but the final commercial decision rests with Archibald. Advisory votes do not modify any membership contract, and the outcome of an advisory vote is not binding on Archibald.
Whether a particular vote is binding or advisory will be stated clearly when the vote is opened.
What is excluded from votes altogether. Membership pricing is determined by Archibald and is not subject to any vote, binding or advisory. Price changes apply only to new members joining after the change takes effect, and do not affect the price already paid by existing members or the renewal price for a Ronin member already inside their membership year. Operational matters that do not materially affect member benefits (corrections, formatting, clarifications, technical maintenance) may be handled by Archibald without a vote.
How votes are conducted. We will provide reasonable advance notice of each vote, including the proposed change or matter under consultation, the rationale, the type of vote (binding or advisory), and the voting window. The voting window will be at least 14 days unless circumstances genuinely require a shorter period. Members cast their votes by signing a transaction from the wallet holding their membership token. A record of each vote, the proposal, the result, and (for binding votes) the effective date is maintained on-chain and made available to members through the DAO interface.
If quorum is not reached on a binding vote. Archibald may either re-propose the change with a longer notice period or shelve it. The change does not take effect.
Kakumei Dantai - Lifetime Membership
Kakumei Dantai is Archibald’s lifetime membership programme. It was co-designed with members of our community and is issued in a strictly limited edition. Once you hold a Kakumei Dantai membership, your benefits continue for the duration of your holding of the membership token, subject to these Terms and to the continued operation of the Archibald membership programme.
Benefits
- Kakumei Dantai membership includes:
- Naked (at-cost) pricing across the entire Archibald collection at all times
- Access to members-only exclusive products and pre-sale access to products not yet available to the public, all at Naked pricing
- Priority service and access to dedicated membership support
- Referral rewards: members earn cash or credit each time a new customer they introduce makes a purchase, equal to the difference between the standard price paid and the member’s Naked price.
- Community influence: the right to vote on matters of product direction, brand strategy, and partnership choices through advisory votes in the Archibald DAO, and to vote on changes to the Kakumei Dantai and Ronin membership programmes through binding votes
- Resale flexibility: the membership token may be resold or transferred to another individual at the holder’s discretion, subject to the conditions below
How your membership is issued
Kakumei Dantai is issued in the form of a non-fungible token (NFT) on the Polygon blockchain, an Ethereum-compatible network chosen for its low transaction fees and energy efficiency. The token is the technical record of your membership: holding it grants access to your benefits; transferring it transfers your membership.
Wallet and key custody
Your Kakumei Dantai membership token is issued to a wallet on the Polygon blockchain. During onboarding, the wallet is generated for you and your seed phrase is displayed once on the onboarding screen. This is the moment to save it.
Please note the following carefully:
- You are solely and entirely responsible for capturing and securely storing your seed phrase at the moment it is shown to you. Archibald strongly recommends recording it on paper or another offline medium, in at least two separate physical locations, before continuing past the onboarding screen.
- Your seed phrase is shown to you only once. Archibald does not retain a copy, will not email it to you, and will never ask you to share it with us.
- Loss of your seed phrase constitutes loss of access to your membership token. Archibald cannot recover lost seed phrases or restore access to a wallet you can no longer reach.
Anyone in possession of your seed phrase has full control of your wallet and your membership. Treat it with the same care you would treat the keys to a safe deposit box. If you believe your seed phrase has been compromised, contact us immediately at info@archibaldlondon.com so we can advise on what (if anything) can be done at the token level.
You may, if you prefer, transfer your membership token from the onboarding wallet to any other Polygon-compatible wallet you control. The membership is held by whoever holds the token, not by the wallet address the token was originally issued to.
Network fees and technical risk
Transaction fees on the Polygon network (“gas fees”) for the initial issuance of your membership token are paid by Archibald. Any subsequent transfers, resales, or interactions involving the token from your wallet are at your own cost and responsibility. You acknowledge that the Polygon network, like any blockchain, is subject to operational risks beyond Archibald’s control, including network downtime, protocol upgrades, or migration to successor networks. In the event of a fundamental change to the Polygon network that affects member access to benefits, Archibald will work in good faith to migrate the membership programme to an equivalent technical arrangement at no cost to existing members.
Transferability and Resale
The Kakumei Dantai membership NFT may be freely resold or transferred to another individual at the holder’s discretion. Archibald has no involvement in, and accepts no liability for, any resale or transfer transaction. Once transferred, all membership benefits pass to the new holder and are no longer accessible to the original holder. Archibald does not take any fee or require any approval in connection with a resale or transfer.
Any resale of the membership NFT takes place between the holder and the new holder on third-party marketplaces over which Archibald has no control. Archibald is not party to any resale transaction, makes no representation as to fair value, and accepts no responsibility for the conduct of secondary-market platforms or counterparties.
Pricing Access
All purchases made using Kakumei Dantai Naked pricing are subject to the same Terms that apply to all other orders placed on this domain, including the returns and shipping terms set out in these Terms. Membership pricing does not alter the applicable returns policy.
Returns & Purchasing Terms
Purchases made using Kakumei Dantai pricing are subject to the same return terms as any other purchase on this domain. Kakumei Dantai pricing is a member benefit; it does not alter the return policy that applies to a given product. For non-customised, non-MTO products, the standard 28-day return window applies, which includes the statutory withdrawal period under EU consumer law. For products in the final-sale categories set out in Section 14, the standard final-sale rule applies. The Re-listing Service for final-sale products is not available to customers purchasing through the European Union Site.
Ronin - Annual Membership
Ronin is Archibald’s annual membership programme. It is designed for members who want access to preferential pricing on the Archibald collection without the lifetime commitment of Kakumei Dantai. The Ronin membership runs for 12 months from the date of purchase and renews only if you choose to renew it.
Benefits
Ronin membership includes:
- Undressed pricing across the Archibald collection for the duration of the membership year (our reduced-margin pricing, see Section 15)
- Voting rights in the Archibald DAO on advisory votes covering product direction, brand strategy, and partnership choices, with each Ronin token carrying one vote
How your membership is recorded
Ronin is issued as a non-transferable, soulbound token on the Polygon blockchain, recorded to a wallet you control and tied to your customer account on the Archibald site. The token gives you access to the Archibald member DAO and your Ronin voting rights for the duration of your active membership. Unlike Kakumei Dantai, the Ronin token cannot be sold, gifted, or transferred. When your membership year ends and is not renewed, the associated voting rights and DAO access lapse.
Duration and Expiry
The Ronin membership is valid for 12 months from the date of purchase. Upon expiry, access to Undressed pricing and DAO participation will cease automatically. Archibald will endeavour to notify members in advance of their expiry date, but it is the member’s responsibility to monitor their membership status via their Archibald dashboard.
Non-Transferability
The Ronin membership is personal to the purchasing account holder and is strictly non-transferable. It may not be resold, gifted, or assigned to any other individual or account.
Pricing Access
All purchases made using Ronin Undressed pricing are subject to the same Terms that apply to all other orders placed on this domain, including the returns and shipping terms set out in these Terms. Membership pricing does not alter the applicable returns policy.
Section 7: Backed By You
Some of our products are offered through our Backed By You campaigns. These items are not held in stock and are produced only if a campaign reaches the threshold of backers required to make production viable. Backed By You lets us bring more ambitious work into the world, manage materials responsibly, and reduce waste, by producing only what our community has actively chosen to support.
How a campaign works
- Pre-order. You place your backing and select your specifications. No payment is taken at this stage. Your card details are recorded so that, if and when the campaign reaches its threshold, payment can be collected automatically.
- Campaign extension. If the campaign period is extended, we will contact you by email to let you know. You may withdraw your backing at any point during an extension without charge or consequence.
- Threshold reached and payment collected. If the campaign reaches its required threshold within the campaign window, we will notify you and collect payment in Euros at the price displayed at the time of pre-order. Production begins shortly after payment is collected.
- Threshold not reached. If the campaign does not reach its required threshold within the campaign window (including any extension), the campaign lapses, no payment is taken, and the order is cancelled at no cost to you. We will notify you by email.
- Campaign withdrawn by Archibald. In rare cases we may withdraw a campaign before its window closes, for example if a supplier becomes unavailable or if production has become unviable. If this happens before payment has been collected, no payment is taken and you are not charged. If this happens after payment has been collected but before dispatch, we will refund you in full within 14 days.
Your right to cancel
You may withdraw your backing at any point before payment is collected, free of charge and for any reason. Once payment has been collected, your order moves into production. Because Backed By You products are produced to order based on the specifications you select at the time of backing, they fall under the exception to the 14-day right of withdrawal set out in Article 16(c) of the EU Consumer Rights Directive 2011/83/EU and §53(4)(3) of the Estonian Law of Obligations Act, which provides an exception for goods made to the consumer’s specifications or clearly personalised. Once production has commenced, the order cannot be cancelled and a refund is not available on a change-of-mind basis.
If you have an issue with the product once it arrives (for example, a manufacturing defect or a fit or sizing concern), please contact us at info@archibaldlondon.com. The standard provisions in Section 13 (Warranty) and Section 14 (Returns & Exchanges) apply, including any product-specific carve-outs set out there.
Delivery windows
Estimated delivery windows provided at the time of backing are indicative only and do not constitute a guaranteed delivery date. Backed By You production timelines depend on supplier capacity, material availability, and the natural rhythm of the workshops we partner with, and they may shift after a campaign closes. We will keep you informed of progress and update you if a meaningful delay arises. Delays in production do not in themselves qualify for cancellation or refund, but where a delay becomes prolonged, the force majeure provisions in Section 19.7 may apply.
Risk and title
Backed By You orders depart from the general title rule in Section 11. Because BBY products do not exist in identifiable form at the time payment is collected, as they are produced after the campaign threshold is reached, payment at the threshold-collection stage does not transfer title in the goods to you. Title transfers when the finished goods are dispatched from our warehouse, at which point they are identified to your order. Risk of loss transfers on delivery to you, in accordance with Section 11.
Currency and pricing
Backed By You orders are denominated in Euros. Payment is collected at the price displayed at the time of backing, regardless of any subsequent change to our published prices.
Section 8: Home Try-On: Three Styles for Five Days
Status: Currently not offered. The Home Try-On service is not active at this time. The terms below are retained for reference, so that customers can see how the service worked in the past and how it would work if we choose to reintroduce it. If we do reintroduce the service, we will update these terms before doing so, and the version published at that time will govern.
Home Try-On allows you to select up to three styles to try at home for five calendar days before deciding whether to keep any of them. If reinstated, the service would operate under the following conditions.
Security pre-authorisation. When you select your Home Try-On Kit, we will place a temporary hold (pre-authorisation) on your registered payment card for an amount sufficient to cover the value of the items in the Kit. No charge is made at this stage. The pre-authorisation reserves the amount and is released or charged depending on the outcome of your trial. Where a pre-authorisation results in a charge, this will be made in Euros.
Return window. Items must be returned within five calendar days of delivery. Returns must be initiated using the prepaid return label provided with your Kit, or via an alternative method we have agreed in writing.
Condition of items. All items must be returned in their original condition: unworn outdoors, unaltered, and with all original packaging, tags, and accessories intact. Handling for the purpose of establishing the nature, characteristics, and functioning of the goods is expected and does not constitute damage. Items showing signs of outdoor wear, alteration, or damage beyond such handling will be assessed under the “Charges” provisions below.
Proof of return. You must retain the proof of postage receipt when dropping off the return at the post office or carrier point, until you have received our confirmation that the return has arrived. The proof of postage is your only evidence that the parcel was sent, if it goes missing in transit.
Confirmation of return. If you do not receive a return confirmation email from us within five working days of posting, please contact us at info@archibaldlondon.com. We will investigate and respond before any charge is considered.
Notice before charging. No charge will be applied to your card without first attempting to contact you. We will email you at least twice, with a minimum of three working days between communications, to give you the opportunity to clarify the position, locate the parcel, or arrange an alternative resolution.
Charges for loss, damage, or non-return
If, after the notice process above, an item from your Kit has not been returned, has been returned damaged beyond fair handling for fit purposes, or cannot be located, we may charge your card for the actual loss we have suffered as a result. This will be calculated on the following basis:
- For an unreturned or lost item: the price the item was offered to you at, less any salvage value if the item is later recovered.
- For a damaged item: the cost to repair the item to resaleable condition, or where repair is not commercially viable, a fair reduction in value reflecting the extent of the damage.
- For a returned item with missing packaging, tags, or accessories: the actual cost to us of replacing the missing components.
We will provide a clear written breakdown of any charge before it is applied. You may dispute any charge by writing to us at info@archibaldlondon.com, and we will pause the charge while we discuss the matter with you.
Misuse of service. Misuse of the Home Try-On service, including repeated delays in return, repeated damage, or repeated failure to return items, may result in the suspension or withdrawal of your access to the service in future, at our discretion.
Statutory rights. Nothing in this section limits any statutory rights you may have under the EU Consumer Rights Directive 2011/83/EU, the Estonian Law of Obligations Act, or applicable consumer protection law in your country of habitual residence, including your right to inspect goods to establish their nature, characteristics, and functioning, and the corresponding rules on assessing diminished value where those goods are returned.
Section 9: Getting Your Archibald Products
9.1. Select Your Designs and Size
We offer a wide range of products, some of which may be available in off-site inventory. If you’re interested in a colour or variation not listed online, feel free to contact us, we may be able to accommodate your request.
Please note: If you have had any conversations with our team about sizing, specifications, or prescription details before making your order, please reconfirm those details after placing your order. Conversations or agreements made before your order are not automatically recorded against your customer account unless followed up post-purchase.
For orders requiring additional confirmation before fulfilment (e.g. size, colour, delivery address, or other specifications), we will reach out to confirm details. If your order remains unfulfilled for over one year and we have not received a response despite outreach, we reserve the right to:
- Release the ordered product back into general inventory
- Convert your payment into Archibald store credit, which you may apply toward the same product (if still available) or an alternative item of equal value.
If you prefer a refund instead (and production has not yet started), please let us know. Where the order has not yet entered production, a full refund will be issued to your original payment method within 14 days. If production has already begun, we may not be able to cancel the order. Where cancellation is still possible, additional fees may apply to cover material, labour, or administrative costs incurred.
Product representations
Some products on the Site are illustrated using renders or mockups rather than photographs. Where this is the case, it will be indicated in the product description. While we work hard to ensure these representations accurately reflect the finished product, slight variations may occur, including small design refinements during production and natural variation in finish, colour, and grain across our materials. These variations are not defects and are part of the character of the goods.
Eyewear
We offer both eyeglasses and sunglasses with a full range of lens options, including prescription and non-prescription, clear or tinted, polarised or non-polarised. If you’re ordering multiple pairs with different prescriptions, you can enter those individually during checkout.
If you’re looking for something specific that isn’t listed, such as a particular lens option, colour variation, or frame detail, get in touch and we’ll do our best to help.
Each acetate frame is cut from a single block, so no two patterns are identical. If you have a visual preference, let us know when ordering and we’ll do our best to accommodate it.
Eyeglasses: Choose your preferred design, and you’ll be prompted to select your lens type and enter prescription information as needed in the customization section.
Sunglasses: Select your frame, then use the “Lens Options” menu to customise your order. Options include tinted non-polarised lenses (non-prescription), polarised lenses, and prescription tinted lenses. Please note: High-index lenses (such as 1.7 or 1.74) may result in a lighter tint compared to standard lenses due to material composition.
Providing Your Prescription
You’ll be prompted to submit your prescription during checkout using a built-in form. Alternatively, you can upload or email a photo of your prescription to info@archibaldlondon.com. If we identify any issues with the information provided (such as an incompatible or incorrect entry), we will contact you and may issue a separate charge to adjust your order accordingly.
Incomplete prescriptions will delay processing. Our team will reach out to collect any missing details. Please ensure your prescription is valid at the time of order. If no expiry date is listed, we typically accept prescriptions dated within two years, in accordance with applicable professional standards in your country of habitual residence.
Pupillary Distance (PD) Measurement
PD, or Pupillary Distance, is required to accurately place your lenses. It is often excluded from prescriptions in certain countries, but opticians who’ve previously dispensed glasses to you should have it on file.
If you’re charged for accessing your PD, we will reimburse up to €15 when you purchase your glasses from us. Please retain and submit your receipt.
We can suggest third-party self-measurement tools online. These can be useful, but may not match the precision of a professional optician. By using any such tools, you accept this risk and understand that we cannot be held liable for inaccuracies resulting from self-reported PD measurements.
Lens Re-glazing
Please note: Our lens re-glazing service is currently unavailable. We’ve left the details below for transparency, in case we choose to reintroduce the programme in the future. Previously, we offered a lens replacement service where customers could send in their Archibald or non-Archibald frames to be refitted with new lenses. Should this service return, full details and instructions will be made available on our website.
Non-Eyewear Products
Selecting the right size can sometimes be challenging. If you’re uncertain, we encourage you to contact our customer service team, we’re happy to assist.
For custom, made-to-order (MTO), or special material products (such as Vicuña, Shell Cordovan, etc.), we are unable to offer change-of-mind refunds, so please ensure you are confident in your sizing and order specifications before placing your order. Your statutory rights in respect of goods that are defective, damaged on arrival, not as described, or incorrectly supplied remain unaffected.
Please note:
- Any size or fit recommendations we provide are suggestions only; we cannot be held responsible if the final product does not fit to your satisfaction.
- Customisations and adjustments are available upon request. These will affect return eligibility and may incur additional charges depending on the nature of the changes.
9.2. Delivery
We require your full name, delivery address, email, and telephone number to dispatch your Archibald order. Please ensure your delivery details are accurate when placing your order and double-check your confirmation email. If you notice any mistakes, contact us immediately at info@archibaldlondon.com. We cannot be held responsible for parcels lost due to incorrect address submissions.
Procedures for parcels marked as dispatched but not received, parcels marked delivered that you have not received, and any customer-side delivery failures, are set out in Section 11 (Risk of Loss & Insurance).
Delivery timelines, shipping options & tracking
Delivery estimates provided at the time of purchase are indicative only. Delays may occur due to circumstances beyond our reasonable control, as set out in Section 19.7 (Force Majeure).
Shipping options and any applicable free shipping thresholds are displayed at checkout before payment is confirmed. All Archibald orders are dispatched with tracking. Archibald ships internationally via a range of carriers, which we select at our discretion depending on your delivery country, the nature of the goods, and operational factors (including courier capacity, customs requirements, and transit routes). If you require guaranteed delivery to a specific date or have particular delivery requirements, please contact us before placing your order and we can advise on how best to process your shipment.
Shipping costs and thresholds are subject to change at any time, and the applicable rate for your order is the one shown at checkout at the time of purchase.
Customs, Import Duties & International Deliveries
For orders dispatched from our European Union fulfilment warehouses, no additional customs duties, import VAT, or clearance fees apply on delivery to your European Union address. VAT is included in the price at checkout under the EU One-Stop Shop (OSS) scheme.
For orders dispatched from our United Kingdom warehouse to your European Union address, two delivery options are available at checkout. Under our standard delivery option, you are the Importer of Record. Import VAT, customs duties, and clearance fees are payable by you to your local customs authority on delivery. Where the courier collects these charges on behalf of the authority, they will be presented to you at the point of delivery. Under our Cleared for You enhanced delivery option, Archibald acts as the Importer of Record and handles all applicable charges as part of a bundled service fee shown at checkout. Full details of the Cleared for You service are set out in Section 1.1. The applicable treatment is disclosed on the product page and in your cart before you complete your purchase.
Customs clearance can occasionally delay delivery. While we will do our best to support the process, we cannot influence the timing of clearance once the parcel is in the hands of your local customs authority.
We are legally required to declare the full and accurate value of all shipments on customs documentation. We cannot mark shipments as gifts or under-declare values, regardless of the reason.
If your country has specific customs regulations or requires particular documentation for the goods you have purchased (for example, leather, copper, or other restricted materials), please inform us promptly after placing your order so we can prepare the necessary paperwork. We may need to delay dispatch while documentation is arranged.
Tracking & Communication
If your parcel does not arrive within the estimated window and you haven’t heard from our team, please check your spam folder, particularly if tracking shows the item as delivered. Reporting deadlines and the procedure for parcels not received are set out in Section 11.
Where a delay does arise, whether from craftsman capacity, workshop schedules, material sourcing, courier disruption, or other production or logistics factors, our customer service team will do their best to keep you informed. This may be by reaching out to you directly with an update, or by updating the status of your order in your Archibald dashboard, which you can view at any time. We will proactively reach out where we become aware of a meaningful delay to your order, and you are always welcome to contact us at info@archibaldlondon.com for a progress update on any order in production. While delays do not in themselves qualify as grounds for cancellation or refund once payment has been collected, we understand that timing matters, and we will work with you in good faith on any specific circumstance where the delay is significant. For prolonged delays outside our reasonable control, the force majeure provisions in Section 19.7 may apply.
Address Changes
If you make changes to your delivery address in your Archibald dashboard after placing your order, please notify us at info@archibaldlondon.com with your name, order number, and updated address, as it does not get updated on your open order automatically. We cannot make changes once a parcel has shipped. In that case, you must contact the courier directly to update delivery arrangements. Additional courier charges may apply depending on the destination.
Combined Shipments
If your order contains multiple items with different dispatch dates, we may hold the shipment until all items are ready. This is part of our effort to reduce unnecessary packaging and emissions. If you need an item dispatched immediately, let us know and we will do our best to accommodate.
In-Transit Cancellations
If a shipment is cancelled after dispatch and the parcel is retrievable, a €50 processing and restocking fee per item will apply, together with any applicable return shipping costs which will be deducted from your refund.
If the parcel cannot be retrieved during transit, you must either accept delivery and return it yourself or refuse delivery so the item is returned to us. A refund will only be issued after we receive the item back in its original condition.
Non-Delivery or Refused Shipments
Where a delivery fails for a reason within your control (as set out in Section 11), the following operational consequences apply:
If the courier returns a shipment due to missed delivery attempts, failure to respond for redelivery, incorrect address, or lack of availability, we will charge you for the cost of re-shipping. If you choose to cancel instead, the €50 processing fee per item plus any processing charges will apply. If the courier disposes of the parcel due to non-response, we cannot be held liable for the loss.
Monitoring Shipments
You are responsible for monitoring your shipment using the tracking number we provide. If you do not receive tracking information around the estimated dispatch window, check your spam folder or contact us for a resend. Should your parcel be returned to us, you will need to cover re-shipping costs or accept the cancellation charges listed above.
If a return is in process, please monitor its progress and be prepared to liaise with the courier if issues arise. Refunds are only processed once the item has safely arrived at our facility in its original condition.
9.3. Payment
Once you’ve selected your products and entered your shipping information, you’ll be prompted to complete payment. You’ll be asked to provide your payment details, along with any valid promotional codes or gift card information. All payments on the European Union Site are processed in Euros.
By submitting your payment details and confirming your order, you authorise us to charge the full amount to your selected payment method. If any changes are made to your order post-purchase (such as added items or service upgrades), we will always confirm with you before applying additional charges.
Coupons and Gift Cards
- Coupon codes are single-use only and cannot be reactivated or reused in the event of cancellations or returns.
- Only one coupon code can be used per order, and coupon codes cannot be combined with one another. E-Gift Cards count as coupon codes for this purpose.
- Coupon codes are not valid for orders made under the Archibald Naked or Membership programmes.
- E-Gift Cards (delivered via email in the form of coupon codes) are treated like standard product purchases and may be cancelled within 28 days of receipt, unless otherwise agreed with a member of the Archibald team.
- If you do not receive your E-Gift Card shortly after purchase, please contact us at info@archibaldlondon.com so we can assist you.
9.4. Dashboard
After placing your order, you will receive a confirmation email containing your order details, including the shipping address, items selected, and the total amount paid. This information is also accessible via your Archibald dashboard, where you can view:
- A full history of your orders
- Order status updates
- Tracking information (when available)
If you have any concerns or questions about your order at any stage, please don’t hesitate to contact us at info@archibaldlondon.com.
Section 10: Changing or Cancelling an Order
Eyewear
After placing your eyewear order, we allow a 24-hour window before confirming the prescription and lens details with our Lens Lab. This time is provided so that you can request changes or cancellations.
If a change leads to a higher cost, our customer service team will contact you to arrange for the updated payment. If a change or cancellation reduces the amount due, we will adjust the authorisation and process the refund accordingly. Cancellations made within this 24-hour window are refunded in full within 14 days.
Where prescription-related customisation has commenced, the lens element of the order falls within the exception to the right of withdrawal set out in Article 16(c) of the EU Consumer Rights Directive 2011/83/EU and §53(4)(3) of the Estonian Law of Obligations Act.
Special or Customised Products
For personalised or customised items, including made-to-order (MTO), made-to-measure, the Goodyear footwear, copper pan sets, and items in special materials such as Horween Shell Cordovan or Vicuña, orders cannot be cancelled once production has started. Other products may also be sold on a final-sale or non-returnable basis as marked clearly on their individual product page. If you change your mind, notify us as soon as possible: where fabrication has not yet begun, we may be able to accommodate cancellation on a case-by-case basis, subject to any material, labour, or administrative costs already incurred. Post-delivery returns for these products are governed by Section 5 (Delivery Windows) and Section 14 (Returns & Exchanges).
Pre-Orders
All Backed By You pre-orders are subject to the terms set out in Section 7. The following applies to all other pre-order batch releases.
Pre-orders placed via batch releases are semi-made-to-order, unless otherwise marked (e.g. explicitly stated as MTO). Please refer to the return terms stated on the individual product page for the specific conditions that apply to each item.
Delays in production do not qualify for cancellation or refund, as such delays often arise from real-time production events (e.g. material or logistics issues).
If you receive a product that doesn’t fit or suit you (e.g. sizing or colour concerns), we may be able to offer store credit in place of a refund, which you can use for an exchange or toward another purchase. We often produce limited extras during pre-order batches to support customers needing size exchanges. However, availability is not guaranteed and depends on the popularity of the style.
Please note: Some items in pre-order batches may also fall under our non-returnable policy due to their personalised nature or premium material composition (e.g. Horween Shell Cordovan, Vicuña, copper pan sets). The applicable return terms are stated on the individual product page. If you are unsure whether your item qualifies, please contact us at info@archibaldlondon.com prior to ordering.
Section 11: Risk of Loss & Insurance
Title and risk of loss.
Title in the goods passes to you on payment. Risk of loss remains with Archibald until the goods are delivered to you or to a person you have identified to receive the goods on your behalf.
Tracking and delivery preferences.
As soon as your order is dispatched, we will send you tracking information via email and your Archibald dashboard. Once the parcel is in the courier’s network, you may set delivery preferences directly with the courier — through their own app or online portal where available, or by contacting the courier directly by phone or email. Options typically include nominating a safe place, redirecting to a neighbour, holding at a depot for collection, or rescheduling for a more convenient day. This is the fastest and most reliable way to ensure your parcel is delivered on terms that suit you.
If you have specific instructions that need to be associated with your order before dispatch, please email us at info@archibaldlondon.com before placing your order so we can note them on your shipment. Our team will do their best to accommodate, though we cannot always guarantee the courier will follow the instruction.
Where you have authorised a specific delivery arrangement — through the courier’s own service, by contacting the courier directly, or through pre-dispatch instructions to us — delivery in accordance with that arrangement constitutes valid delivery, and risk transfers at that point.
Where no delivery preferences are provided, the courier will apply its own delivery method. If the goods are lost, stolen, or damaged before you take physical possession, please contact us at info@archibaldlondon.com within 7 days of the recorded delivery date. We will investigate with the carrier and, where the goods cannot be evidenced as having been delivered into your physical possession or that of a person you have identified to receive on your behalf, we will replace or refund your order.
Customer-side delivery failures.
Risk of loss passes to you at the moment the courier records the parcel as delivered to the address you supplied, or, where delivery cannot be completed for a reason within your control, at the moment that failure occurs. A reason within your control includes, without limitation: failure to pay applicable customs duties, import VAT, or taxes within the courier’s clearance window; failure to respond to delivery, pickup, or re-delivery requests from the courier; refusal of delivery; or providing an incorrect, incomplete, or invalid delivery address.
Where a parcel is returned to us, destroyed by the courier, or otherwise lost or unrecoverable because of a customer-side failure as described above (non-payment of customs, missed pickup, refusal of delivery, no response to the courier, or incorrect address), we are not responsible for the loss and are not obliged to refund or replace the affected order.
Additional Insurance Recommendation
In limited circumstances — for example, when you are returning an item to us where you are responsible for arranging the return shipment under Section 14 — you may be responsible for arranging the return shipment yourself. If the item is high-value or irreplaceable, we strongly recommend arranging enhanced shipping insurance through your chosen provider. If you would like us to explore courier-based insurance options on your behalf, we can do so and confirm any associated costs before you proceed.
Declared value on returns. When shipping a return to us, you must declare the value of the goods on customs documentation at the original sale price paid (or such other value as we agree with you in writing), and the parcel must be clearly marked as a returned item using the appropriate customs codes. If you declare a higher value, for example to support your own insurance arrangements, you do so at your own risk. Any additional import duties, VAT, customs charges, brokerage fees, or related costs that we incur as a result of an over-declared or incorrectly described return shipment will be deducted from your refund or, where the additional cost exceeds the refund due, invoiced to you separately. If you wish to insure a return for more than the sale price, please discuss this with us first so we can advise on how to do so without affecting the customs treatment of the return.
Re-glazing
Please note: Our lens re-glazing service is currently discontinued. It may be arranged in exceptional circumstances through direct communication with the Archibald team, but is not available as a standard service. The terms below are retained for transparency.
If you are returning an item for glazing, repair, or other amendments, especially non-Archibald eyewear, please note that while we typically insure outbound shipments up to €280, there remains a small risk that items could be lost in transit.
Re-Glazing - Loss During Return Transit
In the rare event that a non-Archibald eyewear item is lost during return shipping, we will make every effort to file a claim for the full declared value with the courier. However, final compensation is at the courier’s discretion, and we cannot guarantee full reimbursement. You must provide your original purchase receipt to support any claim.
For Archibald eyewear still in stock or under production, we may be able to offer a replacement or apply any insurance reimbursement toward a similar product.
Damaged Items on Delivery
If your order arrives in a damaged condition, please do not discard the original packaging. Photograph both the packaging and the item immediately upon receipt and contact us within 48 hours at info@archibaldlondon.com or via any of our official contact channels. As the shipper of record on outbound deliveries, Archibald will raise any applicable claim with the courier on your behalf. Reports made after 48 hours may limit our ability to raise a claim. This 48-hour window applies regardless of when the parcel is opened.
Damaged Items on Return
For items damaged during return transit, the customer is the shipper of record and is responsible for raising a claim directly with the courier used. Archibald will assist by providing any documentation or information reasonably required to support the claim, but cannot act as the claimant on a return shipment.
Section 12: Order Access / History
We retain full order records once a purchase has been completed. For orders placed after February 2016, you can access your order history directly via your Archibald dashboard at any time.
If your order was placed before February 2016, or if you experience any difficulty accessing your order history, please contact our customer service team at info@archibaldlondon.com and we will be happy to assist in retrieving the relevant details.
Please note that order records are associated with the email address used at the time of purchase. If you have since changed your email address or created a new account, please contact us directly so we can locate your order and assist accordingly. Our handling of your personal data is governed by our Privacy and Cookie Policy.
Please also be aware that certain changes made to your order, such as amendments communicated directly with our team via email, WhatsApp, or any other channel, are recorded manually as order notes in our system. These changes may not be reflected in your dashboard view. If you have any questions about the current status of your order or any amendments made, please contact us at info@archibaldlondon.com and we will confirm the full details on file.
Section 13: Insurance Claims, Warranty & Care Guide
Insurance
We do not currently work directly with any insurance providers. However, we can provide you with an itemised invoice upon request, which many of our customers have successfully used to submit claims with their own insurance companies.
EU Legal Guarantee
Under EU consumer law, including Directive (EU) 2019/771 on the sale of goods and §218 of the Estonian Law of Obligations Act, we are responsible for ensuring that the goods conform to the contract at the time of delivery. This statutory guarantee applies for a period of two years from the delivery of the goods and covers defects or non-conformities that existed at the time of delivery, even where they only become apparent at a later date.
Notifying us of an issue
If you believe a product does not conform to the contract, you must notify us within 28 days of delivery for issues that would have been apparent on inspection (such as wrong colour, wrong size, visible manufacturing defect, incorrect item received). For issues that only become apparent through use of the product, prompt notification is required, and significant delays may affect the available remedies.
The decision as to whether an issue reported is covered by the statutory guarantee rests with Archibald in the first instance, based on our assessment of the product, the nature of the issue, and the use made of the product. Our decision will be explained to you, and where it differs from your view, our complaint and ADR process is available to you.”
Delays in raising a non-conformity complaint, or use of the product in a way that is inconsistent with the complaint, may limit the remedies available to you. Specifically, where you have used the product in a way that renders it no longer in original re-saleable condition, this is treated as acceptance of the product’s condition at delivery, and the statutory guarantee is unlikely to apply.
What the statutory guarantee does not cover:
- Normal wear and tear arising from use of the product
- Damage caused by improper use, storage, or care
- Damage caused by accidents, including spills, drops, scuffs, or exposure to conditions beyond the product’s reasonable use (such as water damage to products not intended for wet conditions)
- Natural characteristics of materials, including leather patina, grain variation, cashmere pilling, or colour variation
- Alterations, modifications, or repairs carried out by anyone other than Archibald or an authorised repair partner
Your remedies under the statutory guarantee
Where a defect covered by the statutory guarantee is confirmed, we will address the matter under the applicable framework. The appropriate remedy will depend on the specific circumstances of the case and will be determined in accordance with EU consumer law.
Where a defect covered by the statutory guarantee is confirmed, we will address the matter under the applicable framework. The appropriate remedy will depend on the specific circumstances of the case and will be determined in accordance with EU consumer law.
To exercise your rights under the legal guarantee, please contact us at info@archibaldlondon.com with your order details, a description of the issue, and photographs where relevant. We will assess each case individually and respond in good faith. For issues that fall outside the statutory guarantee (such as wear and tear or user damage), our Repair and Resoling Service may be able to help on a paid basis.
Where you are a consumer resident in another EU member state and the mandatory consumer protection rules of your country of habitual residence provide for a longer legal guarantee period or stronger rights than those set out above, those rules continue to apply.
Repair and Resoling Service
Archibald’s products are designed and built, where applicable, to be repairable and resoleable. We offer a repair and resoling service for products in categories where this is technically feasible. Not all products or materials are suitable for repair, and we cannot guarantee that every item can be repaired, particularly where original materials are no longer available, where the item has been modified outside of our authorised repair process, or where the nature of the damage or wear makes repair impractical.
Cost of repair. The cost of a repair depends on the specific circumstances of each case, including the nature of the issue, whether the issue is a result of a manufacturing defect, general wear and tear, user damage, or a combination of these factors. Where an issue is clearly a manufacturing defect covered by the statutory legal guarantee, the repair or replacement will be at no cost to you. Where an issue is clearly a result of normal wear and tear or user action, the cost of the repair will be borne by you. For mixed or borderline cases, we will assess each case individually and discuss the position with you before proceeding, which may include us covering the cost in full, sharing the cost, or confirming the cost will be borne by you.
Request process. Where you contact us about a repair, we will assess the item (where possible, through photographs; or by requesting that you send the item to us for assessment) and provide you with an estimate of the cost, materials, and expected turnaround time, together with our view on whether the issue falls under the statutory guarantee or constitutes wear and tear or user damage. You may then decide whether to proceed with the repair, discuss alternatives with us, or request that the item be returned to you.
Where repair is not practical. For items where a repair is not technically feasible, where the cost of repair would exceed a reasonable commercial threshold, or where the item cannot be returned to a resaleable or usable condition, we will discuss alternatives with you. These may include partial repair, replacement of the item, store credit, a partial refund, or (where none of the above are practical) discontinuation of the item.
Repair and resoling requests are handled on a case-by-case basis. We will do our best to assist in every case and respond in good faith to each request.
Warranty for Manufacturing Defects
If a product arrives with a clear manufacturing defect, we will repair, replace, or process it as a return for refund at our discretion, in accordance with the EU legal guarantee set out above.
If a product develops a manufacturing defect after delivery and is reported within the applicable notification period, please contact us at info@archibaldlondon.com with your order details and photographs of the issue. We will assess each case individually and, where a defect is confirmed, offer an appropriate remedy based on the circumstances.
Note that this does not apply to general wear and tear, damage caused by improper use or storage, or issues arising from modifications made outside of our authorised repair process. Such cases may still be addressed through our Repair and Resoling Service above, at cost.
Care Guide
Archibald provides care guidance for a range of its products at archibaldlondon.com/care-guide. Please note that not all products are currently covered, and the guides available are intended as general reference only. They do not constitute professional advice, and Archibald cannot be held liable for any damage resulting from a customer following or misinterpreting the guidance provided. If you are unsure how to care for, clean, or repair a product, particularly leather, suede, or specialist material items, we strongly recommend consulting a professional such as a local cobbler, leather specialist, or relevant repair service. Any damage resulting from improper care, cleaning, storage, or third-party intervention is not covered under any defect claim.
Section 14: Returns & Exchanges
Different products fall under different return and exchange policies. Some items are eligible for our standard 28-day change-of-mind return; others may have specific carve-outs; and some are non-returnable on a change-of-mind basis. Please review the return terms on the individual product page and contact our team at info@archibaldlondon.com if you have any questions. Any special arrangements made between you and the Archibald team will be honoured.
In rare cases, we may agree to accept returns or exchanges of non-returnable items for store credit, at our discretion. Please note that orders made using that credit, even partially, will not be eligible for return on a change-of-mind basis unless the item is defective.
Your right of withdrawal under EU law
Under Article 9 of the EU Consumer Rights Directive 2011/83/EU and §56 of the Estonian Law of Obligations Act, you have a statutory right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, subject to the exceptions set out below. The 14-day withdrawal period runs from the day you (or a third party identified by you, other than the carrier) acquire physical possession of the goods. Where your order consists of multiple goods delivered separately, the 14-day period runs from the day you receive the last item.
In addition to this statutory right, we provide a further 14-day commercial return period, giving a total of 28 days from receipt of the goods during which you may request a change-of-mind return of eligible items.
How to exercise your right of withdrawal
To exercise your right of withdrawal, you may:
- Use our Withdrawal Button, available in the footer of our Site, in your Archibald account, and in your order confirmation email. The button opens a short form; once you submit and confirm, we will send you an automated confirmation of your withdrawal request on a durable medium (email), and our customer service team will follow up with return instructions.
- Or contact us directly at info@archibaldlondon.com with your name, order number, and a clear statement of your decision to withdraw.
- Both routes have the same legal effect. The 14-day withdrawal period is considered respected if you communicate your decision before the deadline expires.
Exceptions to the right of withdrawal
The statutory 14-day right of withdrawal does not apply to:
Goods made to your specifications or clearly personalised, including the Goodyear footwear, Vicuña pieces, customised eyewear, made-to-measure shirts, Horween Shell Cordovan products, copper pan sets, and any item on which a bespoke customisation has been requested through our customer support team. This exception is set out in Article 16(c) of the EU Consumer Rights Directive and §53(4)(3) of the Estonian Law of Obligations Act. Other items may also fall within the scope of this exception as marked clearly on the individual product page.
Backed By You products once production has commenced, for the same reason.
Other categories specifically identified on the individual product page as non-returnable.
Your statutory rights in respect of goods that are defective, damaged on arrival, not as described, or incorrectly supplied are not affected by these exceptions and remain available to you throughout the two-year EU legal guarantee period (see Section 13).
Return shipping and costs
For eligible returns, you are responsible for arranging and paying for the return shipping of the goods to our United Kingdom warehouse. We will provide the return address and documentation when you initiate the return. In some cases, where we do not have preferred logistics arrangements in your country, we may ask for your assistance in arranging the return; in such cases we will confirm the arrangement in writing before proceeding.
For orders where you paid import VAT, customs duties, or other local taxes on delivery (orders dispatched from our United Kingdom warehouse), those amounts are not refundable by Archibald and remain your responsibility to reclaim (where possible) from your local customs authority. We will provide any documentation reasonably required to support such a reclaim.
Contact Before Returning
Before sending a return, please contact our customer support team at info@archibaldlondon.com or use the Withdrawal Button to initiate the process. We will confirm return eligibility, provide the return address, and advise on any customs documentation required for your return shipment. Returns sent without prior confirmation may be delayed in processing, and we cannot be held responsible for parcels that arrive unannounced or without documentation. Should any additional charges be raised to us as a result of a return being sent without prior confirmation, these will be deducted from the refund amount.
Refund Timing
Once we receive and inspect the returned goods, we will refund the purchase price to your original payment method, in Euros. Under Article 13 of the EU Consumer Rights Directive and §56⁴ of the Estonian Law of Obligations Act, we will process your refund within 14 days of the earliest of: (a) us receiving the returned goods at our warehouse; or (b) us receiving evidence from you that the goods have been sent back to us (such as a tracking number or proof of postage).
For orders that have been dispatched but not yet delivered where you have exercised your right of withdrawal, you are responsible for arranging the return of the goods. This includes either refusing delivery (so the parcel is returned to us automatically) or accepting delivery and arranging the return at your own cost. The refund timing above applies from the earliest of our receipt or your evidence of return.
Defective or Incorrectly Supplied Items
Where an item is returned because it is defective, damaged on arrival, not as described, or incorrectly supplied, Archibald will arrange the return at our cost by providing a prepaid label or arranging carrier pickup. In-transit risk on the return is ours.
We will assess the issue and, where the defect or non-conformity is confirmed, offer an appropriate remedy under the EU legal guarantee. For orders where you paid import VAT, customs duties, or other local taxes on the original delivery, those amounts are not refundable by Archibald and remain your responsibility to reclaim from your local customs authority. We will provide any documentation reasonably required to support such a reclaim.
Where our assessment finds that the item is not in fact defective and does not constitute a non-conformity with the contract, the standard customer-paid return position applies: if we provided a prepaid return label, we may deduct the shipping cost from your refund; if you paid the return shipping, this will not be reimbursed. In such cases, the three-tier assessment set out below under “Returned goods not in re-saleable condition” also applies.
To raise a claim, please contact us at info@archibaldlondon.com with your order number, a description of the issue, and clear photographs of the item and the original packaging. Please retain the item and packaging until the matter has been resolved.
Returned goods not in re-saleable condition
To be eligible for refund, returned items must be in original re-saleable condition — unused, unaltered, with all original packaging, tags, and accessories intact. Handling of the goods to the extent necessary to establish their nature, characteristics, and functioning (as you would in a physical shop) does not affect your right to a refund.
If a returned item is received in a condition that is used, damaged, or otherwise not in original re-saleable condition, we will assess the item and communicate our assessment to you in writing, together with photographic evidence on request, before any decision is finalised. In such cases, we are not able to offer a refund. You may choose to: (a) have the item returned to you with return shipping at your expense; or (b) request that we discard or recycle the item on your behalf at no further cost, on the understanding that no refund will be issued.
If we are unable to reach you, or you do not respond within 21 days of our notice, we will discard or recycle the item at no further cost. If you dispute our assessment, please contact us at info@archibaldlondon.com and we will pause any disposal decision while the matter is discussed in good faith.
Refund Processing and Packaging
Once your return is accepted and confirmed to be in re-saleable condition, we will process your refund. The refund amount will reflect the original amount paid, less any applicable deductions as outlined above. The final amount will be confirmed with you prior to processing, in accordance with any arrangements agreed with the Archibald team. Refunds will be issued to the original payment method used at the time of purchase, in Euros, within the timing set out above.
Please note that refunds are issued to the original payment method in most cases. Store credit may be offered as an alternative in certain circumstances, including where items were purchased at Naked or Undressed pricing, where exchange stock is unavailable, or where a return is accepted on a non-returnable item as a goodwill gesture. Store credit will never be imposed without your agreement, except where specified in these Terms.
All original packaging, including shoe boxes, eyewear cases, and suit covers, must be returned in reusable condition. A fee of €15 will apply if packaging is returned damaged or unsuitable for reuse.
If your order originally qualified for free shipping and you return part of the order bringing the remaining value below the free shipping threshold, the original shipping cost will be deducted from your refund or invoiced separately.
Non-Customised Items
If your purchase is not quite right, you have 28 days from receiving your order to request an exchange or return. This includes the statutory withdrawal period required under EU consumer law. Simply contact us or use the Withdrawal Button to initiate the process.
We do not accept change-of-mind returns or exchanges for perishable goods, personalised or customised items (including made-to-measure and made-to-order products), or items with a specific non-return policy as stated on their product page. Your statutory rights in respect of goods that are defective, damaged on arrival, not as described, or incorrectly supplied remain unaffected.
Please note that items purchased from our Samples, One-offs, and Discontinued collection are exempt from the 28-day return window and are not eligible for change-of-mind return, unless otherwise agreed in writing with a member of the Archibald team. These items are sold on a final-sale basis and this is stated clearly on the individual product page at the time of purchase. Your statutory rights for defective items remain unaffected.
Final-Sale Products
Certain Archibald products are sold on a final-sale basis and are not eligible for change-of-mind return. This typically applies where a product is produced in small, limited quantities; uses specialist or regulated materials; involves craftsmanship that cannot be reproduced for a return shipment; or where the nature of the item makes general returns processing operationally unworkable. The categories named below are the obvious examples, but other items may also be sold on a final-sale basis — including limited editions, samples, discontinued pieces, collaborations with specific craftsmen, or any other product so marked. The applicable return terms for each product are stated clearly on the individual product page, and we encourage you to review these before ordering.
Vicuña products. Vicuña is a CITES-protected fibre subject to strict international traceability, storage, and provenance requirements throughout its life. These requirements govern how the material is sourced, transported, and handled at every stage, and cannot reasonably be reproduced for a return shipment. This makes it operationally unworkable to accept vicuña items back into general returns processing. Vicuña items are therefore not eligible for return on a change-of-mind basis.
Horween Shell Cordovan and the Goodyear footwear. These are produced to order in small batches by a limited number of specialist craftsmen. Archibald does not hold standard stock in these categories. Items are not eligible for change-of-mind return, whether produced specifically for your order or made available as part of a limited release.
Copper pan sets. Our copper pan sets are produced in limited numbers by specialist copper craftsmen and are not held as standard stock. Due to the value, specialist nature, and limited inventory of these sets, copper pan sets are sold on a final-sale basis and are not eligible for change-of-mind return. Individual copper pieces purchased separately from a set are subject to our standard 28-day return window, provided they are returned in original re-saleable condition.
Deliveries of final-sale products may also experience unforeseen delays due to factors such as material sourcing, workshop closures, additional quality control checks, or required export documentation.
If a product in this category does not fit, please contact us at info@archibaldlondon.com and we will discuss what options may be available to you on a case-by-case basis.
Your statutory rights in respect of goods that are defective, damaged on arrival, not as described, or incorrectly supplied remain unaffected and are addressed under the EU legal guarantee set out in Section 13.
Eyewear Returns
We offer returns within 28 days for frame-only orders and sunglasses from our 1-day Stock Sunglasses collection, in accordance with the standard return window set out above.
Any order requiring lens glazing, whether for non-prescription clear lenses, sunglasses lenses, or prescription lenses, is treated as a customised item falling within the exception to the 14-day right of withdrawal under Article 16(c) of the EU Consumer Rights Directive. Even if the specifications match those of our 1-day Stock Sunglasses, if your order is fulfilled from a different warehouse or sent elsewhere for glazing, it will be classed as customised.
For returns involving non-prescription sunglasses, prescription lenses, prescription sunglasses, progressive (varifocal) lenses, or any order where we have contacted you about additional lens-related charges, we offer a full refund for the frame only (provided it is returned in original condition). The lens cost is non-refundable, as these are made to order. We do not add markup to our lens pricing, so any charges related to returns reflect only the actual cost to us.
Orders with high prescription values (CYL higher than +2.00 or below -2.00; SPH higher than +6.00 or below -6.00; or divergent SPH and CYL values) require extra care and processing. Please contact us before returning any high prescription order.

Membership Returns
Kakumei Dantai and Ronin members are subject to the same return terms as all other customers, applied by product category rather than membership tier. The Re-listing Service for final-sale products is not available to customers purchasing through the European Union Site.
Re-listing Service
The Re-listing Service for final-sale products (Horween Shell Cordovan, Vicuña, and the Goodyear footwear) is not available to customers purchasing through the European Union Site. If you have purchased a final-sale product and have genuine sizing or fit concerns, please contact us at info@archibaldlondon.com and we will discuss what options may be available to you on a case-by-case basis.
Section 15: Special Considerations — Archibald Naked and Undressed
Naked and Undressed pricing also form the basis of Archibald’s active membership programmes. Kakumei Dantai members access Naked pricing across the entire Archibald collection at all times. Ronin members access Undressed pricing for the duration of their membership year. The mechanics of those memberships are set out in Section 6.
The Naked and Undressed campaigns are not permanently active but may be reintroduced from time to time. When they are, the terms in this section will apply alongside the standard Terms set out elsewhere in this document.
Background: Archibald has run two special pricing campaigns over the years: Naked and Undressed.
Naked was our original cost-price campaign. Subscribers were given access to the full Archibald collection at the prices we paid our craftsmen, with no margin layered on top. The idea was simple: we would tell our customers exactly what their goods cost us to make, and let them decide what was fair.
Undressed came next. As we grew, we wanted to offer something that sat between full retail and full transparency, a reduced margin that still let us invest in the brand and the team while making the work more accessible. Undressed pricing is the answer to that question.
Both campaigns are built on the same principle: trust. We trusted that customers who saw what their goods actually cost to produce would understand the value of what they were buying, and would choose to support the brand on those terms. They did, and that trust is the foundation of everything we have built since.
Access to both campaigns has historically been granted through a referral model, with customers invited to share the campaign with people they knew. We may continue this approach, modify it, or replace it in future campaigns at our discretion.
Returns and other terms. Purchases made during Naked or Undressed campaigns are subject to the same return, delivery, and other terms set out elsewhere in this document. No additional return rights or restrictions apply by virtue of the campaign pricing.

WHEN USING THE SERVICES, YOU DO SO AT YOUR OWN RISK AND UNDER YOUR SOLE AUTHORITY. THERE IS NO SPECIAL RELATIONSHIP BETWEEN YOU AND ARCHIBALD, AND WE DO NOT ASSUME RESPONSIBILITY FOR YOUR USE OF THE SERVICES.
YOU AGREE THAT ARCHIBALD HAS NO CONTROL OVER, AND NO OBLIGATION TO TAKE ANY ACTION REGARDING: THE CONTENT YOU ACCESS VIA THE SERVICES; HOW YOU MAY INTERPRET OR USE SUCH CONTENT; WHAT EFFECT THE CONTENT MAY HAVE ON YOU; WHICH USERS GAIN ACCESS TO THE SERVICES; OR WHAT ACTIONS YOU MAY TAKE AS A RESULT OF YOUR EXPOSURE TO ANY CONTENT.

ARCHIBALD IS NOT LIABLE FOR ANY DAMAGES OR LOSSES RESULTING FROM SUCH DEALINGS, INCLUDING BUT NOT LIMITED TO PAYMENT ISSUES, DELIVERY DISPUTES, WARRANTIES, OR REPRESENTATIONS.

ARCHIBALD DOES NOT WARRANT THAT THE SERVICES OR CONTENT WILL BE ACCURATE, COMPLETE, AVAILABLE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.
Nothing in this warranty disclaimer limits or excludes any rights you may have as a consumer under EU consumer law, including the EU legal guarantee of conformity (Directive (EU) 2019/771), the EU Consumer Rights Directive 2011/83/EU, the Estonian Law of Obligations Act, or the mandatory consumer protection law of your country of habitual residence. In particular, nothing in these Terms affects your rights in respect of goods purchased from Archibald that are defective, damaged on arrival, not as described, or incorrectly supplied, which are governed by Section 13 (EU Legal Guarantee).
Section 18: Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ARCHIBALD OR ANYONE REPRESENTING ARCHIBALD BE LIABLE TO YOU UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL OR EQUITABLE THEORY FOR:
ANY LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER RESULTING FROM: (I) YOUR ACCESS TO, USE OF, OR RELIANCE ON ANY CONTENT PROVIDED THROUGH THE SERVICES, OR ANY ERRORS OR OMISSIONS IN ANY CONTENT; (II) ANY UNAUTHORISED ACCESS TO OR USE OF THE SERVICES OR SECURE SERVERS BELONGING TO ARCHIBALD, AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN; (III) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES; OR (IV) ANY VIRUSES, BUGS, TROJAN HORSES, OR SIMILAR ISSUES THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY.
ANY DIRECT DAMAGES IN EXCESS OF THE GREATER OF: (I) THE FEES PAID TO US FOR THE APPLICABLE PRODUCTS; OR (II) €400.
THESE LIMITATIONS APPLY REGARDLESS OF LEGAL THEORY AND WHETHER OR NOT ARCHIBALD WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in this section excludes or limits our liability for:
Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Defective products causing damage to consumer property, where such liability cannot be excluded under the EU Product Liability Directive (Directive 85/374/EEC, as amended, and its national implementations)
Any liability for breach of the EU legal guarantee of conformity under Directive (EU) 2019/771 and §218 of the Estonian Law of Obligations Act
Any liability that cannot be excluded or limited under applicable consumer protection law, including the mandatory consumer protection rules of your country of habitual residence
Where applicable consumer protection laws provide you with rights that cannot be excluded or limited by agreement, those rights remain unaffected by these Terms.
Section 19: Termination, Governing Law, Severability, Entire Agreement & Miscellaneous
19.1. Termination
We reserve the right to terminate or suspend your access to our services at any time, without prior notice or liability, for any reason including but not limited to a breach of these Terms. In such cases, any rights granted to you under these Terms will immediately cease, but your obligations to Archibald, including any outstanding payments or responsibilities, will remain in effect.
Where we are specifically directed by an applicable law or regulatory authority to act in a particular manner in connection with the termination or suspension of a user’s access, we will comply with that direction.
19.2. Governing Law and Jurisdiction
These Terms, and any sale made under them, are governed by and shall be interpreted in accordance with the laws of the Republic of Estonia, including in particular the Estonian Law of Obligations Act (Võlaõigusseadus), without regard to its conflict of laws provisions.
Where you are a consumer resident in another EU member state, mandatory consumer protection rules of your country of habitual residence continue to apply to the extent they provide you with stronger rights than these Terms or Estonian law. This is in accordance with Article 6 of Regulation (EC) No 593/2008 on the law applicable to contractual obligations (Rome I). Nothing in these Terms affects those rights.
The parties agree that the courts of the Republic of Estonia shall have non-exclusive jurisdiction to hear and determine any dispute arising out of or in connection with these Terms, including any non-contractual disputes. Nothing in this clause prevents you, as a consumer, from bringing a claim in the courts of your country of habitual residence under applicable consumer protection laws that cannot be excluded by contract.
19.3. Severability
If any provision of these Terms is found to be invalid, void, or unenforceable for any reason, that provision will be deemed severable and will be limited or removed to the minimum extent necessary. The remainder of the Terms will continue in full force and effect and will not be affected or impaired.
19.4. Entire Agreement
These Terms constitute the complete agreement between you and Archibald regarding the services and supersede any prior general communications or proposals, whether oral, written, or electronic. However, this does not affect or override any specific written arrangements or agreements made between you and Archibald on a case-by-case basis, which will continue to be honoured. Any rights not expressly granted herein are reserved.
For the avoidance of doubt, any arrangements or amendments agreed directly with the Archibald team, whether by email, WhatsApp, or any other written channel, form part of your individual agreement with us and are honoured accordingly, even where they differ from the standard terms set out here.
19.5. Miscellaneous
Archibald is committed to maintaining the highest standards of customer service. Where circumstances beyond our reasonable control affect our ability to perform, the force majeure provisions in Section 19.7 apply.
You may not sublicense, transfer, or assign any of your rights or obligations under these Terms without our prior written consent. Archibald may freely transfer, assign, or delegate its rights and obligations without restriction, including by transferring the operation of the European Union Site to another Archibald group entity, provided that your rights under these Terms are not materially reduced as a result.
These Terms do not create any form of partnership, joint venture, agency, or employment relationship between you and Archibald. Neither party has the authority to bind the other in any manner.
Our decision not to enforce any provision of these Terms does not waive our right to do so at a later time. Any waiver or modification of these Terms must be provided in writing by an authorised Archibald representative.
Headings and section titles in these Terms are provided for convenience only and do not affect their interpretation.
Language of these Terms. These Terms are originally drafted in English. Where a translated version of these Terms is published in another language, the translation is provided for information purposes only. In the event of any discrepancy or ambiguity between the English and the translated version, the English version shall prevail. Should you have any questions or require clarification on anything, please contact info@archibaldlondon.com.
For any questions about these Terms or how they apply to you, please contact us at info@archibaldlondon.com.
19.6. Complaints and Dispute Resolution
If you have a concern about a product or service you have received from us, please contact our customer support team first at info@archibaldlondon.com. We aim to acknowledge complaints within five working days and to resolve them within thirty days where possible. Most issues are resolved informally and to mutual satisfaction at this stage.
If we are unable to resolve a complaint to your satisfaction, you may refer the matter to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon), which is the alternative dispute resolution body designated under Estonian law:
Tarbijavaidluste komisjon
Pronksi 12, 10117 Tallinn, Estonia
avaldus@komisjon.ee
www.komisjon.ee
Participation in dispute resolution before the Estonian Consumer Disputes Committee is voluntary for Archibald. Where you are a consumer resident in another EU member state, you may also refer the matter to the alternative dispute resolution body designated under the law of your country of habitual residence. A list of designated ADR bodies across the EU is maintained by the European Commission.
Nothing in this clause prevents you from exercising any other rights you may have, including the right to bring proceedings in the courts of your country of habitual residence.
19.7. Force Majeure
Archibald will not be liable for any failure or delay in performing our obligations under these Terms where the failure or delay is caused by events or circumstances beyond our reasonable control. These include, but are not limited to:
acts of God, fire, flood, earthquake, severe weather, or other natural disasters
war, armed conflict, terrorism, civil unrest, or government action
epidemic, pandemic, or public health emergency
strikes, lockouts, or other industrial disputes (whether involving our workforce, our suppliers’ workforces, or third parties)
failure or interruption of utilities, telecommunications, or transport networks
port closures, customs delays, or border restrictions affecting international shipments
failure or insolvency of a supplier or workshop on which we depend, where no equivalent alternative is reasonably available
shortage or unavailability of raw materials, including but not limited to leather, vicuña, cashmere, and other natural materials whose availability is subject to seasonal, agricultural, or regulatory factors
cyberattack, denial of service, or other malicious interference with our systems or those of our suppliers, payment processors, or logistics partners
Where a force majeure event affects our ability to fulfil your order, we will notify you as soon as reasonably practicable, explain the nature of the delay, and provide an updated estimate where possible. We will work in good faith to perform our obligations as soon as the event has passed.
If a force majeure event continues for more than 90 days and prevents us from delivering your order, you may cancel the affected portion of your order and we will refund any payment made for the affected items, less any costs already incurred on your behalf that cannot reasonably be recovered (such as bespoke materials already cut, or production already commenced on a made-to-order item). For made-to-order, Backed By You, and other non-returnable items, we will work with you in good faith to agree a fair outcome, which may include a credit, a replacement once production resumes, or a partial refund reflecting the work already completed.
Nothing in this clause limits or excludes any right you may have under applicable consumer law that cannot be excluded or limited by contract.
